The Good Geeks strives to provide the best possible service and information to all of our customers, and we will not tolerate any abuse on our servers. These brief guidelines are imposed to protect you, other The Good Geeks customers and us against such harm. By hosting your domain with The Good Geeks, you are agreeing to all of our Terms of Service (TOS).

Payment Policy
To keep our costs down, The Good Geeks bills for our services on a yearly or bi-yearly basis. Payments are to be made at account set-up. Payment renewal invoices are sent 30 days before the prepaid time is up. Billing will could continue until you cancel your hosting account. You may cancel at anytime.

Refund Policy
Refunds will be given for our hosting services on a monthly prorated basis. If you paid for hosting from February 15, 2003 - February 14, 2004 and you cancel on April 17, 2003, you will be given a refund for nine (9) months. If you paid for web hosting for this time and you cancel on April 9, 2003, you will be given a refund for ten (10) months. Domain Registration fees are not refunded. If you cancel hosting services with The Good Geeks, you will still maintain full ownership rights to your domain(s) for the period it was registered (it will be your responsibility to maintain the registration of your domain).

Cancellation Policy
The Good Geeks's Refund Policy only applies when service is cancelled by the customer. If cancellation is done by The Good Geeks due to violation of TOS, there will be no refund. Failure to follow any term or condition will be grounds for immediate account deactivation. We reserve the right to refuse, cancel, or suspend service at our sole discretion. Server abuse policy
Any attempt to undermine or cause harm to a server, or customer, of The Good Geeks is strictly prohibited. If we determine that any site on our servers is using too much of the server's resources and therefore abusing the server, we have the right to suspend that domain without any notice. It is then up to you to contact us and formulate a plan to get that domain activated again. We are quick to suspend any domain that abuses the server's resources due to the shared nature of the server and the negative impact an abusing domain has on other domains on the same server.
Running programs in the background on a The Good Geeks server without our prior written authorization, or running chat rooms, Internet Relay Chat, IRC bots, more than 1,000 emails a day and the like are not acceptable uses of The Good Geeks's servers. Usage of scripts or other utilities to direct pointed domain names to subdirectories without prior authorization is prohibited. We can set-up an additional domain name to be pointed to your site's IP address for a one time $25 setup fee.
Our goal is to assist our customers in any way we can to ensure the success of your site. However, you should understand that your site is on a shared server with other sites. Any abuse by one user will affect all other clients on that server. If there is ever a problem we will make every effort to remedy the situation in a mutually beneficial way.

SPAM Policy
The Good Geeks has a zero-tolerance, anti-Spamming policy. Under this policy, we prohibit Spam, or any unsolicited email, from being sent over the network, and over any other network if the message advertises a site hosted on the The Good Geeks servers. We react quickly and seriously to violations, and we further reserve the right to terminate the services, without prior notice, of any customer disregarding this policy.

Content Policy
All services provided by The Good Geeks may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The customer agrees to indemnify and hold harmless The Good Geeks from any claims resulting from the use of the service which damages the subscriber or any other party. Examples of unacceptable content are Pirated software, Hacker programs, and Warez sites.

Traffic Policy
The Good Geeks has four hosting plans that allow for very generous traffic, and most sites never reach 500MB per month, unless they offer shareware, sound, video, image and multimedia archives, are mirror sites or any site whose primary purpose is file distribution. We discourage our customers from storing any files that cause excessive traffic.
All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and bill $5.00 for each gig of traffic exceeded. You will NOT be charged for transfer that you use beyond our generous data transfer limits without prior notification. You can monitor your transfer at anytime in your Control Panel.

Backups
Full backups are made regularly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the customer's responsibility to maintain local copies of their web content.
A backup manager is an included feature in all of The Good Geeks's hosting packages for the use of the customer. If loss of data occurs due to an error of The Good Geeks, we will attempt to recover the data for no charge. If data loss occurs due an error of the customer, The Good Geeks will attempted to revert the site to the most recent archive for a $50.00 fee.

Indemnification Policy
You agree to use all The Good Geeks services and facilities at your own risk. The Good Geeks specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall The Good Geeks be liable for any loss, loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, and hold The Good Geeks harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against The Good Geeks, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it’s agents, employees or assigns.
